काशीपुर। उत्तराखंड गठन के समय से ही हिन्दी उत्तराखंड की राजभाषा है और उच्च न्यायालय के अतिरिक्त सभी प्राधिकारियों व न्यायालयों में हिन्दी का सभी कार्य में प्रयोग किये जाने का प्रावधान है। लेकिन 2001 में गठित उत्तराखंड लोक सेवा अधिकरण में अभी तक हिन्दी का प्रयोग न्यायिक कार्यों में नहीं हो रहा था। माकाक्स अध्यक्ष तथा सूचना अधिकार कार्यकर्ता नदीम उद्दीन एडवोकेट की पहल व उनके अनुरोध पर लोक सेवा अधिकरण में न्यायिक कार्यों सहित सभी कार्यों में हिन्दी प्रयोग का रास्ता खुल गया हैै। नैनीताल पीठ में उनके द्वारा हिन्दी में दायर पहली दावा याचिका सुनवाई हेतु स्वीकार भी कर ली गयी है। प्रतिष्ठित समाज सेवी संस्था माकाक्स के अध्यक्ष तथा सूचना अधिकार कार्यकर्ता व 25 वर्षों से अधिक से कानूनी क्षेत्र में हिन्दी के प्रयोग को बढ़ावा देने को संघर्षरत नदीम उद्दीन एडवोकेट ने लोक सेवा अधिकरण के अध्यक्ष जस्टिस यू.सी.ध्यानी से अधिकरण के सभी कार्यों में हिन्दी के प्रयोग करवाने का अनुरोध अपने पत्रांक 101 दिनांक 19-02-2021 से किया था। उन्होंने उत्तराखंड में लागू उ0प्र0 लोक सेवा अधिकरण (प्रक्रिया) नियमावली 1992 के नियम 3 तथा उ0प्र0 लोक सेवा अधिकरण पद्वति नियमावली 1997 के नियम 4 की ओर अध्यक्ष का ध्यान भी आकर्षित कराया था जिसमें अधिकरण की भाषा देवनागरी लिपि में हिन्दी होने तथा सभी याचिकाओं व प्रार्थना पत्रों में हिन्दी प्रयोग का प्रावधान है। श्री नदीम के अनुरोध के उपरान्त उत्तराखंड सरकार की ओर से विभिन्न केसों में दाखिल किये गये काउन्टर एफिडेविट लीखित कथन हिन्दी में फाइल किये गये तथा अधिकरण द्वारा स्वीकार किये गये।31 अगस्त 2021 को नदीम उद्दीन एडवोकेट द्वारा पुलिस कांस्टेबिल कपिल कुमार की दावा याचिका (क्लेम पिटीशन) हिन्दी में नैनीताल पीठ में दाखिल की गयी जिसे केस नं0 73/एनबी/डीबी/2021 के रूप में दर्ज किया गया तथा अधिकरण के अध्यक्ष न्यायमूर्ति यू.सी.ध्यानी तथा उपाध्यक्ष राजीव गुप्ता की पीठ ने श्री नदीम व ए.पी.ओ को सुनने के उपरान्त इसे सुनवाई हेतु स्वीकार करते हुये अपने आदेश दिनांक 02 सितम्बर 2021 से विपक्षीगण को नोटिस जारी करने तथा 6 सप्ताह में लिखित कथन/काउंटर एफिडेविट के दाखिल करने का आदेश दिया गया तथा केस में अगली तिथि 25 अक्टूबर 2021 लगायी गयी। अगस्त 2021 में ही विभिन्न केसों में श्री नदीम द्वारा हिन्दी में ही प्रत्युत्तर शपथपत्र (रिज्वाइंडर एफिडेविट) फाइल किये गये जिसे अधिकरण द्वारा स्वीकार किया गया। श्री नदीम ने बताया कि अधिकरण द्वारा हिन्दी में दावा याचिका (क्लेम पिटीशन), काउन्टर एफिडेविट तथा रिज्वांइडर एफिडेविट स्वीकार करने से अधिकरण में सभी कार्यों में हिन्दी प्रयोेग का रास्ता खुल गया। इससे पूर्व अधिकरण के लोक सूचना अधिकारी द्वारा न्यायिक कार्य में हिन्दी प्रयोग न होने तथा अंग्रेजी प्रयोग का कोई नियम उपलब्ध न होना श्री नदीम के सूचना प्रार्थना पत्र के उत्तर में स्वीकार किया था। नैैनीताल पीठ में श्री नदीम द्वारा दाखिल कपिल कुमार की दावा याचिका हिन्दी में दाखिल पहली याचिका है। इससे पूर्व हिन्दी में कोई दावा याचिका स्वीकार किये जाने की पीठ के कर्मचारियों को भी कोई जानकारी नहीं हैै।श्री नदीम इससे पूर्व ही न्याय क्षेत्र में हिन्दी प्रयोग को बढ़ावा देने को 1995 से ही संघर्षरत रहे हैै। जहां 1995 से अब तक उनकी आसान हिन्दी में कानूनी जानकारी देने वाली 44 कानूनी पुस्तकें प्रकाशित हो चुकी है, वहीं हिन्दी के माध्यम सहित एल-एल.बी. कक्षाओं का के.जी.के.काॅलेज मुरादाबाद व बरेली काॅलेज बरेली में 15 वर्षों तक शिक्षण तथा हिन्दी भाषी न्यायिक अधिकारियों को बढ़ावा देने के लिये नदीम के एल.एल.बी. लैैक्चर्स नामक यू टयूब चैनल के माध्यम से कानूनी क्षेत्र में हिन्दी को बढ़ावा दिया। इसके अतिरिक्त सूचना अधिकार का प्रयोग करके जहां उत्तराखंड मानवाधिकार आयोग सहित विभिन्न आयोगों व अधिकरणों में हिन्दी के प्रयोग को बढ़ावा दिया वहीं उत्तराखंड उच्च न्यायालय में हिन्दी का वैकल्पिक प्रयोग किये जा सकने की शासन से स्थिति स्पष्ट करायी।
