रुद्रपुर 04 अक्टूबर 2022- जिला मजिस्ट्रेट युगल किशोर पन्त ने दण्ड प्रक्रिया संहिता 1973 की धारा 144 के तहत शक्तियों का प्रयोग करते हुए जनपद उधमसिंहनगर में पराली, पुआल आदि को खेतों में व अन्य स्थानों पर जलाने पर विधिवत आदेश जारी करते हुए तत्काल प्रभाव से सम्पूर्ण रूप से रोक लगा दी है।
जिला मजिस्ट्रेट युगल किशोर पन्त ने बताया कि विभिन्न माध्यमों, स्रोतों से ज्ञात हुआ है जनपद में फसल कटाई के उपरांत खाली खेतों में बची हुई (अवशेष), गिरी हुई पुआल को जलाया जाता है, जिससे जहां एक ओर पर्यावरण एवं वातावरण प्रदूषित होता है, वहीं बुजुर्गों, छोटे बच्चों के साथ ही आम जनमानस को भी श्वास संबंधी परेशानियों का सामना करना पड़ता है। इसके अतिरिक्त पर्यावरण एवं वातावरण में फैली धुंध से परिवहन में भी काफी दिक्कतें आती हैं।
विभिन्न स्रोतों, माध्यमों से प्राप्त सूचनाओं, नेशनल ग्रीन ट्रिब्यूनल के निर्णय एवं चारे की कमी की सम्भावनाओं को देखते हुए वर्तमान स्थिति में पराली, पुआल आदि जलाये जाने पर प्रतिबन्ध लगा दिया है।
जिला मजिस्ट्रेट ने कहा कि चूंकि परिस्थितियाँ आपातकालिक स्वरूप की हैं तथा यह सम्भव नहीं है कि व्यक्ति एवं व्यक्तियों के समूह को नोटिस दिया जा सके। अतः यह आदेश जनहित में एक पक्षीय पारित किया जा रहा है। इस आदेश का उल्लंघन वर्तमान में प्रवृत्त अन्य कानूनों के प्रासंगिक प्राविधानों व नियमों के तहत अनुमन्य न होने के कारण भा0द0सं0 की धारा-188 सपठित वायु एवं प्रदूषण नियन्त्रण अधिनियम 1981 के तहत दण्डनीय है।
