काशीपुर। प्रथम अपर जिला एवं सत्र न्यायालय सुवीर कुमार ने विजयपाल पुत्र ओमप्रकाश निवासी बहोरनपुर थाना भगतपुर जिला मुरादाबाद, डालचंद शर्मा पुत्र जसराम शर्मा आवास विकास काशीपुर, सुधीर शर्मा पुत्र डालचंद शर्मा निवासी आवास विकास काशीपुर को मुकदमा अपराध संख्या 8/2016 में 398, 401 आईपीसी व 25 आर्म्स एक्ट के अंतर्गत दोषमुक्त कर दिया।
अभियोजन का कथानक था कि18 जनवरी 2016 को अरुण कुमार सैनी पुलिस टीम के साथ रात्रि 13.30 बजे जैतपुर मोड़ पर ड्यूटी पर थे। मुखबिर ने सूचना दी कि तीन व्यक्ति एक जुते हुए खेत में सुनसान में तमंचे, चाकू, बोल्ट खोलने की चाबी आदि घातक हथियारों से लैस होकर लूट की योजना बना रहे हैं। पुलिस द्वारा आवश्यक बल प्रयोग करके उक्त लोगों को पकड़ लिया और उनके कब्जे से दो तमंचे व एक चाकू व बोल्ट खोलने की चाबियां मिली। पुलिस द्वारा उन्हें थाने लाया गया और उनके खिलाफ अपराध संख्या 8/2016 धारा 398 401 व 25आर्म्स एक्ट थाना आईटीआई में मुकदमा पंजीकृत किया। जांच अधिकारी कमलेश भट्ट ने मुकदमे की जांच की और आरोप पत्र न्यायालय में प्रस्तुत किया। न्यायालय में आरोप का विचारण करते हुए अभियोजन पक्ष एवं बचाव पक्ष को सुना अभियोजन पक्ष की तरफ से गवाह एसओ अरुण सैनी, एसआई सुधाकर जोशी, कांस्टेबल शंकर आर्य, कमलेश भट्ट, कां. दीपक कठैत, कां. संजय कुमार, एसआई भीम भास्कर आर्य गवाहों को परीक्षित कराया गया तथा बरामद तमंचे चाकू और जिलाधिकारी की मुकदमा चलाए जाने की अनुमति व अन्य दस्तावेज अभियोजन द्वारा पेश किए गए। न्यायाधीश सुबीर कुमार ने अभियोजन पक्ष की ओर से अतिरिक्त जिला शासकीय अधिवक्ता एवं बचाव पक्ष के अधिवक्ता शैलेंद्र कुमार मिश्रा व भास्कर त्यागी को सुना व पत्रावली का गहनता से परिशीलन करने के बाद संदेह का लाभ देते हुए दोषमुक्त कर दिया।
