समान नागरिक संहिता के अन्तर्गत विशेष परिस्थितियों में सबको एक से अधिक पत्नियां रखने की अनुमति होनी चाहिये। इस सुझाव सहित उत्तराखंड समान नागरिक संहिता विशेष समिति को राष्ट्रीय स्तरीय सूचना अधिकार कार्यकर्ता, 44 कानूनी पुस्तकों के लेखक, पूर्व लाॅ लैक्चर नदीम उद्दीन (एडवोकेट) ने विस्तृत सुझाव दिये है।
उत्तराखंड समान नागरिक संहिता विशेषज्ञ समिति के सार्वजनिक आमंत्रण पर काशीपुर निवासी नदीम उद्दीन एडवोकेट ने विस्तृत सुझाव अधिकारिक वेबसाइड पर अपलोड करके दिये हैै। इसमें उत्तराखंड में समान नागरिक संहिता लागू करने की कानूनी बाध्यताओें, विवाह, तलाक, उत्तराधिकार तथा दत्तक ग्रहण (गोद लेने) सम्बन्धी कानूनों से सम्बन्धित सुझाव शामिल हैै।
श्री नदीम द्वारा राज्य समान नगारिक संहिता लागू करना, प्रदेश में लागू होने के कारण अनुच्छेद 44 के निदेशों के अनुरूप न होने, केन्द्रीय कानूनों व स्वतंत्रता से पहले से लागू कानूनों में संशोधन की आवश्यकता, राज्य के बाहर जाकर उल्लंघन संभव तथा भारत के विधि आयोग की 31 अगस्त 2018 की रिपोर्ट में उल्लेखित संवैधानिक व अन्य बाधायें शामिल हैैं।
श्री नदीम के विवाह सम्बन्धी कानूनोें सम्बन्धी संशोधन कें सुझावों में जन्म मृत्यु के समान सभी विवाहों का अनिवार्य रजिस्ट्रेशन, विशेष परिस्थिति में एक से अधिक पत्नियां रखने की अनुमति, दहेज पर पूर्ण प्रतिबंध के लिये दहेज वाले विवाह को अवैध माना जाना, लिव इन रिलेशन का रजिस्ट्रेशन व विवाह के समान दायित्व मानने वाले सुप्रीम कोर्ट के निर्णयों के परिप्रेक्ष्य में कानूनी प्रावधान शामिल है।
श्री नदीम के तलाक सम्बन्धी कानूनों के सुझावों में सभी तलाकों का अनिवार्य रजिस्ट्रेशन, आपसी सहमति व पुरूषों द्वारा विशेष परिस्थितियों में न्यायालय के बाहर तलाक, तलाक चुनौती व तलाक के मामलों का निस्तारण अधिकतम तीन माह में करने के प्रावधान शामिल है।
श्री नदीम के उत्तराधिकार सम्बन्धी कानूनों के सुझावों में मनमानी वसीयत व जैविक उत्तराधिकारियों को बेदखल करने पर प्रतिबंध, एच.यू.एफ.की भेदभाव पूर्ण व्यवस्था की समाप्ति, महिलाओं को पुरूषों के वास्तविक समान सम्पत्ति अधिकार सुनिश्चित कराने के प्रावधान शामिल है।
श्री नदीम के दत्तक ग्रहण (गोद लेने) सम्बन्धी कानूनों के सुझावों में न्यायहित, धोखाधड़ी से अपराधों से बचाव तथा जैविक संतानों के अधिकारों के संरक्षण हेतु मनमाने दत्तक ग्रहण (गोद लेने) पर प्रतिबंध व अनिवार्य रजिस्ट्रेशन शामिल है।
उत्तराखण्ड की राजभाषा हिन्दी होने व केवल अंग्रेजी जानने वालों की नगण्य संख्या के आधार पर समिति की संस्तुति, मसौदे, रिपोर्ट हिन्दी में प्रस्तृत करने का भी सुझाव दिया हैै।
श्री नदीम के इन विस्तृत सुझावों में इन सुझावों वाले प्रावधानों की उपयोगिता का भी उल्लेख किया हैै। इसके अनुसार विशेष परिस्थितियों में एक से अधिक अधिकतम 4 तक पत्नियों की अनुमति, मौजूदा पत्नि/ पत्नियों की लिखित अनुमति से दी जा सकती हैै। मौैजूदा पत्नि/पत्नियों से विवाद, मानसिक स्थिति बीमारी के चलते पति को पुनः विवाह की अनुमति न देने पर सक्षम न्यायालय द्वारा अनुमति दी जा सकती है।
इसके अतिरिक्त एक से अधिक पत्नियां रखने वाले पति द्वारा सभी पत्नियों के साथ समान व्यवहार न करने पर इसे ’’क्रूरता’’ मानते हुये पीड़ित पत्नि को घरेलू हिंसा अधिनियम के अन्तर्गत उपचार पाने का अधिकार होना चाहिये।
इसकी आवश्यकता को उल्लेख करते हुये श्री नदीम नेे इसे पति की अधिक शारीरिक जरूरतें, पत्नि की लगातार बीमारी आदि, पत्नि के संतान उत्पत्ति को सक्षम न होना, पत्नि की संतान उत्पत्ति व लालन पालन की इच्छा न होना, सभी विवाह की इच्छा रखने वाली महिलाओं को विवाह का सुख देने के लिये तथा व्यभिचार तथा वैश्यावृत्ति नियंत्रण हेतु आवश्यक बताया है। इन सुझावों में यह भी स्पष्ट किया हैै कि बहुपत्नि विवाह का जनसंख्या वृद्धि से कोई सम्बन्धी नहीं हैै।
